1. Introduction and Acceptance

These Terms of Use (the “Terms”) govern your access to and use of the Ominies mobile application and the website at ominies.com(together, the “Service”). The Service is operated by an individual sole proprietor based in the Arab Republic of Egypt (“Ominies,” “we,” “us,” or “our”). You can reach us at support@ominies.com.

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. These Terms are effective as of May 4, 2026.

2. Eligibility

You must be at least 13 years old to use the Service. If you are located in the European Economic Area or the United Kingdom, you must be at least 16. If you are under the age of majority in your place of residence (typically 18), you may only use the Service with the involvement and permission of a parent or legal guardian who agrees to these Terms on your behalf.

3. The Service

Ominies is a mobile application that helps you discover top dishes at a restaurant by analyzing publicly available reviews from third-party sources. You can browse restaurants, view dishes extracted from those reviews, save favorites, add private notes, and submit your own ratings.

Dish names, descriptions, ingredient and dietary indicators (such as vegetarian, vegan, spicy, or potential allergens), and suggestions for similar restaurants are produced automatically from publicly available data and may contain errors, omissions, or stale information. The Service is provided for general informational purposes only. You should always verify dish ingredients, allergens, prices, opening hours, and any other detail directly with the restaurant before relying on it, especially if you have any health, religious, or dietary restrictions.

4. Accounts

You can use parts of the Service as a guest. To unlock the full experience you create an account by signing in with Apple or Google. You are responsible for maintaining the confidentiality of the credentials and devices used to access your account and for all activity that occurs under it. You agree to provide accurate information and to keep one account per person. You must notify us promptly at support@ominies.com if you suspect any unauthorized use.

5. Your Content

The Service lets you submit content such as dish ratings (on a 0–100 scale), optional review comments, and private notes on restaurants and dishes you favorite (“Your Content”). You retain ownership of Your Content.

By submitting Your Content, you grant Ominies a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from, communicate, and display Your Content for the purposes of operating, providing, securing, and improving the Service. This license includes the right to use ratings on an aggregated and de-identified basis (for example, blending your rating into a dish’s overall score). The license lasts as long as Your Content exists in the Service and ends when Your Content is deleted, except for aggregated and de-identified derivatives that no longer identify you.

You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe any third party rights or any law. You agree not to submit content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit, or that contains spam, malware, or personal data of other people.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to derive the source code of the Service, except where such restriction is prohibited by applicable law.
  • Scrape, crawl, or otherwise access the Service through automated means, or use the Service to build a competing dataset.
  • Interfere with, disrupt, overload, or attempt to bypass any security, authentication, or rate-limiting mechanism.
  • Circumvent or abuse free-tier usage limits, including by creating multiple accounts or by tampering with device identifiers used to enforce those limits.
  • Impersonate any person or entity or misrepresent your affiliation with anyone.
  • Use the Service in any way that violates any applicable law, regulation, or third-party right.

7. Subscriptions (“Ominies Pro”)

Some features of the Service are available only to subscribers of our paid tier, “Ominies Pro.” The free tier is subject to usage limits that we may change at any time without notice. The current limits are shown in the app at the moment they apply.

All paid subscriptions are sold and processed by Apple App Store on iOS and by Google Play on Android, with subscription management facilitated by our third-party provider RevenueCat. The available subscriptions, their prices in your local currency, and their billing periods are shown to you in the app at the time of purchase, before you confirm.

Free trials. We may offer a free trial period from time to time. If a trial is offered to you, its length and the price that will be charged at the end of the trial are disclosed to you in the app before you start the trial.

Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price for that subscription, unless you cancel at least 24 hours before the end of the current period. Your App Store or Google Play account is charged when the renewal occurs. You can manage and cancel your subscription at any time from your App Store or Google Play account settings; cancelling stops future renewals but does not terminate the current paid period.

Refunds. Because all billing is processed by Apple and Google, all refund requests must be made directly through them, in accordance with the App Store or Google Play refund policies. Ominies does not process refunds itself and does not refund the unused portion of a current paid period. Nothing in these Terms limits any non-waivable statutory consumer right that you may have under the law of your country of residence (including, where applicable, the right of withdrawal for digital content under EU consumer law).

8. Third-Party Services

The Service relies on third-party providers, including Apple, Google, Supabase, and RevenueCat, and integrates with publicly available restaurant information from third-party sources. Your use of those third-party services is governed by their own terms and privacy policies, which we do not control. We are not responsible for third-party content, services, or practices.

9. Modifications, Suspension, and Termination

We may add, change, suspend, or discontinue features of the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that exposes us or other users to risk or legal liability.

You can stop using the Service at any time and delete your account from the Profile screen in the app. Account deletion is described in our Privacy Policy. If you have an active paid subscription, you must cancel it from your Apple or Google account before deleting your Ominies account; we cannot cancel store-managed subscriptions on your behalf.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, uninterrupted operation, or freedom from error or harmful components. We make no warranty that dish information, restaurant information, dietary or allergen indicators, or recommendations will be accurate, complete, current, or suitable for any particular purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ominies will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or related to the Service will not exceed the greater of (a) the total amount you paid us through the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty US dollars (US$50).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, willful misconduct, or for the mandatory consumer-protection rights of users in the European Economic Area, the United Kingdom, or any US state.

12. Indemnification

You agree to defend, indemnify, and hold Ominies harmless from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Governing Law and Disputes

These Terms are governed by the laws of the Arab Republic of Egypt, without regard to its conflict-of-law rules. The competent courts of Cairo, Egypt have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except that, where you reside in a jurisdiction whose law gives you a non-waivable right to bring proceedings in your local courts or to benefit from local consumer protection rules, that right is preserved.

14. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Ominies regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a reorganization, merger, or sale of assets.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you by posting the updated Terms in the Service with a revised “Last updated” date and, where appropriate, by an in-app notice. Your continued use of the Service after the updated Terms take effect means you accept them. If you do not agree, you must stop using the Service.
